The petitioners apprehend their arrest in Raj Nagar P.S. Case No. 79/2016, registered for the offences punishable under Sections 409, 420 and 34 of the Indian Penal Code. The Block Education Officer, Raj Nagar alleged that petitioners being the Incharge Headmaster and Secretary Vidyalaya Shiksha Samittee respectively withdrew Rs. 9,26,400/- for construction of school building, but construction work of worth Rs. 6,77,135/- was done till the lodging of the case. Learned counsel for the petitioners submits that from perusal of the measurement book, it would appear that the work of Rs. 9,42,261/- was done till 07.02.2017 and petitioners have

Patna High Court Cr.Misc. No.34517 of 2017 (2) dt.10-08-2017 2/2 withdrew Rs. 9,26,400/- upto 10.02.2016. The petitioners have already completed construction work of Rs. 9,42,261/- till 07.02.2017.

Considering the facts aforesaid, the petitioners, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of Judicial Magistrate Ist Class, Madhubani in connection with Raj Nagar P.S. Case No. 79/2016, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
