JUSTICE ARUN KUMAR ORAL ORDER 06-07-2017 Heard learned counsel for the petitioner and the learned APP appearing on behalf of the State. Petitioner apprehends his arrest in connection with Dehri (Town) P.S. Case No.490 of 2015 registered under Sections 341, 323, 332, 353, 307, 379, 504, 506 and 34 of the Indian Penal Code and Section 27 of the Arms Act.

Allegation is that the informant, a police officer while on duty reached near his residence at Nil Kothi, three accused persons sitting on a motorcycle tried to tease a girl, when informant objected the accused persons abused him and thereafter they reached to the house of the informant along with some other persons and indulged in scuffling with the informant, opened fire in the air and in the meanwhile a police vehicle came and out of 10-12 miscreant, one was apprehended, who disclosed the name of

Learned counsel for the petitioner submits that there is no evidence against the petitioner except disclosure of his name by one Satish Kumar Singh, apprehended at the spot and similarly situated another co-accused Titu Kumar was granted anticipatory bail by a coordinate Bench of this Court by order dated 23.03.2017, passed in Cr. Misc. No.13038 of 2017. Having considered the said facts and circumstances, in the event of arrest/surrender within four weeks from the date of receipt of this order to the concerned court, let the petitioner, named above, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Sasaram (Rohtas) in connection with Dehri (Town) P.S. Case No.490 of 2015, subject to the conditions as laid down under Section 438(2) Cr.P.C.
