The petitioners are languishing in custody since 09.04.2014 and 08.04.2014 respectively in a case registered for the offences punishable under Sections 399, 402, 414 and 120(B) of the Indian Penal Code and Sections 25(1-B)a, 26 and 35 of the Arms Act.
On the secret information that the miscreants are preparing to commit road robbery, raid was laid when seven persons were apprehended from a Bolero vehicle. From the house
Patna High Court Cr.Misc. No.36293 of 2014 (4) dt.13-01-2015 of the petitioner Birendra Rai a stolen tractor was recovered whereas from the possession of petitioner Indal Bhagat @ Ranjeet one revolver, four live cartridges and two mobiles were recovered. It is submitted on behalf of the petitioner Birendra Rai that he gave his tractor for repair at the garage of Indrajeet Paswan who supplied him another tractor which was recovered from his house and this petitioner has no criminal antecedent. It is submitted on behalf of the petitioner Indal Bhagat @ Ranjeet that the recovery was actually not made from his possession.
Considering the period under custody, let the above named petitioners be released on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate-1st Class, East Champaran, Motihari/learned Chief Judicial Magistrate, East Champaran at Motihari in connection with Chakiya P.S. Case No. 95 of 2014.
