The petitioner is in custody in connection with Rail Bhagalpur P.S. Case No. 57 of 2019 for the offences under Sections 401, 414, 420 of the Indian Penal Code. Learned counsel for the petitioner submits that the petitioner has no criminal antecedent and he is in custody since 12.03.2019. He further submits that petitioner was apprehended by the police and from his possession ATM Card was recovered but no stolen article was recovered from the conscious possession of the petitioner and petitioner is mobile mechanic and he repairs the mobile.

Considering the fact that petitioner has no criminal
