JUSTICE DINESH KUMAR SINGH ORAL ORDER 19-01-2015 Heard learned senior counsel for the petitioner and learned A.P.P. for the State.

The petitioner is languishing in custody since 21.07.2014 in a case registered for the offences punishable under Sections 414 of the Indian Penal Code and 25(1-b)a, 26 and 35 of the Arm Act. From possession of the petitioner 56 live cartridges, Rs.10,360/- cash and three suspected stolen Mobiles were recovered.

It is submitted by learned senior counsel for the petitioner that the seizure list reflects that seizure was made near New Area Modern School which suggests that the seizure was not made from possession of the petitioner. A statement has been made in paragraph no. 3 of the petition that the petitioner has no criminal antecedent.

Considering the aforesaid facts, let the

No.40526 of 2014 (3) dt.19-01-2015 2 / 2 petitioner above named be released on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Nawada, in connection with Nawada Town P.S. Case No. 433 of 2014.
