The Petitioner is apprehending his arrest in Kudhani P.S. Case No. 362 of 2016 registered for the offence punishable under Sections 399, 402, 414 of the Indian Penal Code, Sections 25(1-B)a, 26(ii) and 35 of the Arms Act and Section 8, 20(b)II(B) of the NDPS Act.

It has been submitted on behalf of the petitioner that the petitioner is not named in the FIR and he has been implicated in this case on the basis of confessional statement of co-accused Vivek Kumar and Nitesh Kumar. Whereas co-accused Nitesh Kumar has been granted regular bail vide order dated 10.03.2017 in Criminal Miscellaneous No. 8187 of 2017. The petitioner has also got no criminal antecedent.

No.31983 of 2017 (2) dt.13-07-2017 2/2 Considering the aforesaid facts and circumstances of the case, let the petitioner named above in the event of arrest or surrender before the court below within four weeks from today, be released on bail upon furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge-cum-Spl Judge, Muzaffarpur, in connection with Kudhani P.S. Case No. 362 of 2016; subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure, 1973.
