JUSTICE ANIL KUMAR UPADHYAY ORAL JUDGMENT Date : 11-10-2018 Vide order dated 17.4.2013 this case was directed to be listed along with the record of CWJC No. 12280 of 2012 which was disposed of by order dated 10.9.2018. The Court has issued direction to the respondents to include the name of the petitioners of that case in the gradation list at appropriate place considering their seniority as the petitioners of that case were aggrieved by non-inclusion of their names in the gradation list. So far as the present writ petition is concerned, the grievance of the petitioner is non-placement of his name at the appropriate place in the gradation list considering his initial date of appointment and other factors determining seniority.

Considering the fact that CWJC No. 12280 of 2012 was disposed of by order dated 10.9.2018 whereby direction was issued by this Court for

Patna High Court CWJC No.13439 of 2012 dt.11-10-2018 2/2 inclusion of names of the petitioners of that case at appropriate place in the gradation list, the Court finds it appropriate to issue same direction in the present case also to include the name of the petitioner in the gradation list at appropriate place reflecting his seniority accordingly to his date of initial appointment, date of birth and other factors for determination of inter se seniority.

The respondents are accordingly directed to pass necessary order with regard to the petitioner of this case within a maximum period of four months from the date of receipt/production of a copy of this order.
