2. The petitioner seeks bail in connection with Chapra Town P.S. Case No. 4 of 2025 instituted for the offences punishable under Sections 103(1), 61(2) of the BNS and Section 27 of the Arms Act.
3. As per the prosecution case, the petitioner and others are accused of committing the murder of the deceased.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence and has falsely been implicated in this case merely on the basis of mere suspicion. He submits that petitioner has been falsely implicated in this case due to previous enmity. He further submits that there is no eye witness to the occurrence. He next submits that there is no incriminating articles has been recovered from the conscious
Patna High Court CR. MISC. No. 47993 of 2025(3) dt.08-10-2025 2/3 possession of the petitioner or from his house. Petitioner has got clean antecedent as stated in para 3 of the petition is in custody since 05.01.2025.
5. Learned APP for the State opposes the prayer for bail.

From perusal of the FIR, case diary, postmortem report and the impugned order of the learned Additional Sessions Judge-VI, Saran at Chapra dated 30.04.2025, it appears that on the basis of written report of the informant Shashikant Prasad, FIR has been registered under Sections 103(1), 61(2) of the BNS and Section 27 of the Arms Act against five accused persons including the present petitioner. The allegation against the petitioner is that on 03.01.2025 at around 8 P.M. brother of the informant namely Sri Kant Patel went outside with his brother namely Ravi Shankar Kumar. On 8:30 PM, Ravi Shankar Kumar informed by phone to the informant that his brother namely Sri Kant Patel is admitted in Sadar Hospital. Further, when the informant reached Sadar Hospital, he found that his brother namely Sri Kant Patel is lying dead. It is alleged that this information has been given by the present petitioner along with other FIR named accused persons. Similarly situated co-accused persons namely Amit Kumar Singh @ Raja and
Patna High Court CR. MISC. No. 47993 of 2025(3) dt.08-10-2025 3/3 Ajeet Kumar, who have been granted bail by a Co-ordinate Benches of this Court in Cr. Misc. Nos. 59095 of 2025 and 44353 of 2025 vide orders dated 26.09.2025 and 18.07.2025 respectively, so considering all these aspects of the case and submissions of learned counsel for the petitioner, I am inclined to grant bail to the petitioner.
7. Accordingly the prayer for bail of the petitioner is allowed. Let the petitioner above named be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Saran at Chapra in connection with Chapra Town P.S. Case No. 4 of 2025.
