The petitioner apprehends arrest in connection with Tarhagachh P.S. Case No. 39 of 2016 registered under Sections 302 and other allied sections of the Indian Penal Code. Learned counsel appearing on behalf of the petitioner submits that nothing specific has been alleged against this petitioner. Specific allegations are against other co-accused persons. In fact, the deceased died due to Chronic disease. Post mortem report suggests that the cause of death is due to chronic lung disease. Petitioner has no criminal antecedent. Having considered the facts and circumstances of the case, let the above named petitioner be released on bail, in the

No.23463 of 2017 (3) dt.06-07-2017 event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Kishanganj in connection with Tarhagachh P.S. Case No. 39 of 2016 subject to the condition as laid down under Section 438(2) of the Cr. P.C.
