The petitioners are apprehending their arrest in connection with Dhaka P.S. Case No. 03 of 2017 for the offences instituted under Sections 341, 323, 504, 506, 324 and 307/34 of the Indian Penal Code.
There is allegation against co-accused namely Angoor Khan for assaulting the brother of the informant with iron rod. The petitioners are also said to be the member of unlawful
Patna High Court Cr.Misc. No.28251 of 2017 (3) dt.06-07-2017 2/2 assembly.
It has been submitted on behalf of the petitioners that except petitioner no.1 and 13, petitioners have got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioners. General and omnibus allegation has been made against the petitioners. No specific injury has been attributed against the petitioners. On the order of petitioner no.1, the other petitioners are said to have assaulted the deceased. The specific allegation is against Angoor Khan.
On behalf of the State, it has been submitted that the petitioners are named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioners above named be released on anticipatory bail in the event of their arrest or surrender before the learned court below within a period of six weeks from today in connection with Dhaka P.S. Case No. 03 of 2017 on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Sikrahna at Dhaka, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
