2. This is the 2nd Attempt on behalf of the petitioner for anticipatory bail in connection with Turkauliya (Banjariya) P.S. Case No. 119 of 2021 registered for the offence punishable under Sections 341, 323, 313, 354, 379, 504/34 of the Indian Penal Code.
3. Earlier the prayer of the petitioner for anticipatory bail was rejected vide Cr. Misc. No. 53788 of 2021 dated 24.05.2022.
4. The petitioner has preferred this application for anticipatory bail after three years of its rejection. In view of the judgment of the Hon'ble Supreme Court in the case of G.R. Ananda Babu Vs. State of Tamil Nadu and another reported in
Patna High Court CR. MISC. No.45093 of 2025(2) dt.01-08-2025 2/2 2021 SCC OnLine SC 176, second anticipatory bail on behalf of the petitioner is not maintainable. It is, accordingly, dismissed.
5. It appears that for last three years, the SHO of Banjariya, East Champaran and the other police officials of Banjariya Police Station are helping the accused and not arresting her.
6. The Superintendent of Police, East Champaran is directed to initiate appropriate proceedings against the police officials involved in helping the accused and not arresting her despite the rejection of the anticipatory bail by this Court.
7. The petitioner is directed to surrender before the Court below within two weeks from today failing which the Superintendent of Police, East Champaran will take all possible steps to arrest the petitioner.
8. Let a copy of this order be communicated to the Superintendent of Police, East Champaran through FAX for its compliance forthwith.
