JUSTICE SANJAY PRIYA ORAL ORDER 4/ 13-02-2019 This application has been filed for modification of the order dated 02.05.2018 passed in Cr. Misc. No.9627 of 2018 by which petitioner was granted anticipatory bail in connection with Complaint Case No. C-173 of 2014 to the satisfaction of the Sub-Divisional Judicial Magistrate, Bagaha, West Champaran, with certain conditions.

By order dated 12.12.2018 passed in instant case, petitioner was directed to return the price of thirty thousand bricks of first quality to the Complainant within two months. Interim order was passed that petitioner will not be arrested in the meantime.

Today, again prayer has been made to extend the time

Patna High Court Cr.Misc. No.56520 of 2018(4) dt.13-02-2019 2/2 for returning the price of bricks.

This Court does not find any merit in this application since the petitioner has not complied the direction of this Court. In view of such, this modification application is dismissed.

Interim order dated 12.09.2018 as well as 12.12.2018 passed in the instant case is hereby vacated. The petitioner is directed to surrender before the Court below and make prayer for regular bail, which shall be considered and disposed off in accordance with law without being prejudiced by this order.
