The petitioner seeks bail in Sahiyara P.S. Case No. 78 of 2012, corresponding to Sessions Trial No. 02 of 2013, registered for the offence punishable under Section 302 of the Indian Penal Code.
The prayer for bail of the petitioner was earlier rejected vide order dated 29.11.2013 passed in Cr. Misc. No. 26316 of 2013 and the petitioner made second attempt.
It appears that the trial has already begun. Considering the facts aforesaid and the fact that there is specific allegation against the petitioner that he killed the father of the informant by assaulting him with spade, I am not inclined to enlarge the petitioner above named on bail. Accordingly, the same is rejected.
