JUSTICE ARUN KUMAR ORAL ORDER 06-07-2017 Heard learned counsel for the petitioner and the learned APP appearing on behalf of the State. Petitioner apprehends his arrest in connection with Complaint Case No.C 554/13 registered under Sections 406 and 504 of the Indian Penal Code.
Allegation is that the petitioner sought loan of Rs.20,000/- which the complainant deposited in his account, further Rs.1,15,000/- was demanded by petitioner and the complainant gave the same through cheque. Again the complainant transferred Rs.42,000/- in the account of the petitioner but the money was not returned.
Learned counsel for the petitioner submits that no loan was taken by the petitioner from the complainant rather he

Having considered the said facts and circumstances, as the dispute appears primarily civil in nature so in the event of arrest/surrender within four weeks from the date of receipt of this order to the concerned court, let the petitioner, named above, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Gopalganj in connection with Complaint Case No.C 554/13, subject to the conditions as laid down under Section 438(2) Cr.P.C.
