Petitioner apprehends his arrest in Muffasil P.S. Case No.127 of 2019, registered under Section 30(a) of the Bihar Prohibition and Excise Act.

The informant got information that petitioner had kept liquor in his house. On such a raid was conducted and from one of the rooms in which husk was stored three cartons containing Indian made foreign liquor were recovered.

Learned counsel for the petitioner submits that only 27 litres Indian made foreign liquor was recovered that too from the husk room and not from the conscious possession of the petitioner.

Taking into consideration the fact that 27 litres of Indian made foreign liquor was recovered from the house of the

Patna High Court CR. MISC. No.48897 of 2019(2) dt.06-08-2019 2/2 petitioner, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the prayer for anticipatory bail of the petitioner is rejected.
