JUSTICE ANIL KUMAR SINHA ORAL ORDER 09-12-2022 Heard Mr. Natraj Verma, learned counsel for the petitioner and Ms. Ashal Kumari, learned Additional Public Prosecutor for the State through video conferencing. Petitioner seeks regular bail in connection with Baikunthpur PS Case No. 164/2022 registered for the offence punishable under Sections 413, 414/34 of the IPC. As per First Information Report, the police intercepted a motorcycle on which three persons were riding and upon seeing the police personnel, two of them succeed in fleeing away and the petitioner was apprehended by the police. The motorcycle in question was found to be a stolen one. Learned counsel for the petitioner submits that the motorcycle was not being driven by the petitioner and he was not aware of the fact that the said motorcycle was a stolen property. Patna High Court CR. MISC. No.47070 of 2022(2) dt.09-12-2022 2/2 in custody since 09.06.2022 and the charge-sheet in the matter has already been submitted and there is no likelihood that the petitioner will abscond or will tamper with the evidences, if released on bail.

Having regard to the submissions made by the parties and taking into consideration the material on record and the fact that the petitioner is in custody since 09.06.2022, the chargesheet in the matter has been submitted and there is no likelihood that the petitioner will abscond or will tamper with the evidences, I am inclined to grant regular bail to the petitioner subject to the conditions that the petitioner will be well represented on each and every date in the trial and if he fails to do so on two consecutive dates, his bail bonds will be liable to be cancelled.

Accordingly, let the petitioner, RANJEET KUMAR be released on bail on furnishing bail bond of Rs. 20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gopalganj in connection with Baikunthpur PS Case No. 164/2022.
