JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 13-08-2018 Heard learned counsel for the petitioner and the counsel appearing on behalf of the State as well as University. On behalf of the petitioner I.A. No. 6725 of 2016 has been filed for substitution of original petitioner. The original petitioner died leaving behind the legal heirs as mentioned in para-2 of the I.A. No. 6725 of 2016.

In view of the averments made in the I.A. No. 6725 of 2016 the same is allowed and the name of Anand Kumar Choudhary and Prabhat Choudhary be substituted in place of original petitioner.

The controversy involved in the present writ application is for payment of salary for certain period.

Patna High Court CWJC No.15891 of 2012(3) dt.13-08-2018 2/2 Learned counsel appearing on behalf of the University on instruction submits that payment has been made to the original petitioner.

Learned counsel for the petitioner disputed the contention of the counsel for the University. Under the aforesaid circumstances, without going into the controversy whether the original petitioner was actually paid the entire arrears or not, liberty shall be available to the substituted petitioners to file representation before the Registrar of the University who shall examine the claim of the substituted petitioners and if there is anything payable to the substituted petitioner, the Registrar will pass appropriate order with regard to claim of the substituted petitioners within a maximum period of four months from the date of receipt/production of a copy of the order.

With the aforesaid, the writ petition stands disposed of.
