The petitioner apprehends his arrest in connection with Madhepura P. S. Case No. 778 of 2016 instituted under Sections 302, 201/34 and 120B of the Indian Penal Code and Section 27 of Arms Act.

The allegation, in brief, is that accused persons came on a vehicle and forcibly kidnapped the brother of the informant and on subsequent day, dead body along with another dead body were recovered.

Learned counsel for the petitioner submits that there is no allegation against this petitioner except that he was also sitting in the vehicle and he is a person of another village. Whereas learned A.P.P. submits that allegation is that

Patna High Court Cr.Misc. No.38962 of 2017 (2) dt.19-08-2017 2/2 all accused persons forcibly kidnapped the informant's brother and thereafter he was murdered and his dead body was found along with dead body of another person and this petitioner has got six criminal antecedents of serious nature.

Having considered the aforesaid facts and circumstances of the case, the prayer for anticipatory bail of the petitioner stands rejected.
