JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 07-08-2019 The petitioner is seeking direction to the respondents to determine the petitioner's claim for compensation against acquisition of his land for National Thermal Power Corporation, Barh.

It appears to be an admitted fact that an acquisition proceeding was undertaken in respect of the land in question and part payment of the amount of compensation, according to the petitioner himself, has been made against the said acquisition. The upsum of the petitioner's contention is that though he was entitled to receive the amount of compensation, the same is being sought to be paid to someone, who is not

It appears from the pleadings on records itself that the petitioner had not raised any objection at the time of notification. His claim is based on execution of a gift deed by his maternal grandmother on 03.09.1949 and subsequent judgment in a title suit. He had represented before the District Land Acquisition Officer and on his direction, the Circle Officer has submitted certain reports.

Learned counsel appearing on behalf of the petitioner contends that the matter is still pending with the Land Acquisition Officer.

In such view of the matter, this application is disposed of with the observation that let a decision be taken by the District Land Acquisition Officer in accordance with law on the petitioner's claim of compensation within a reasonable time. (Chakradhari Sharan Singh, J) Pawan/- U
