The petitioner has preferred this application for grant of regular bail in a case registered under sections 420, 467, 468, 471 and 34 of the Indian Penal Code and sections 20 and 22 of the NDPS Act.

As per the prosecution case, 115 grms of charas was recovered from the possession of the petitioner besides other articles.

It is submitted by learned counsel for the petitioner that besides the allegations in the FIR being false, the alleged recovery is below the commercial quantity. His case stands on a similar footing to that of co-accused Vicky Kumar who has been enlarged on bail vide order dated 17.9.2021 passed in Cr. Misc.

Having heard learned counsel for the parties and taking into consideration the submissions made on behalf of the petitioner together with grant of bail to the co-accused, the Court directs the petitioner to be enlarged on bail in connection with Sadar P.S. Case no. 426 of 2020 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District Judge I, Muzaffarpur.
