Petitioner seeks bail in a case registered for the offence punishable under Section 324, 307, 427, 120-B of the Indian Penal Code and 27 of the Arms Act.

Informant has alleged in this written complaint that while he had gone market to purchase medicine along with his friend and was returning, 3-4 persons who were demolishing house of his co-villager Vijay Rai and as they stopped them, one of them took out pistol and fired upon them and thereafter they fled away. Petitioner was a pillion rider and the pellet hit his waist. It is further alleged that his friend recognized the accused after seeing their photographs as Rana Bishwash, Rabindra Bishwash and Chandu Bishwash (Petitioner) who fired upon

It has been submitted on behalf of the petitioner that he is innocent and has been falsely implicated in this case only on suspicion and animosity. He has no criminal antecedent and he is in custody since 27.03.2021.

Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 20,000/- with two sureties of the like amount each to the satisfaction of learned court below where the case is pending in connection with Shikarpur P.S. Case No. 172/2021 with following conditions:-

(1) Both the bailors shall be the resident of territorial jurisdiction of the learned court-below.

(2) The petitioner shall fully cooperate with the investigation / trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner. (S. Kumar, J) Rajiv/veenaU
