JUSTICE VINOD KUMAR SINHA ORAL ORDER 13-09-2018 The petitioner is apprehending his arrest in connection with Saharsa P.S. Case No. 328 of 2018, registered for offences punishable under Section 392 of the Indian Penal Code. Allegation against the petitioner is of committing robbery in the shop of the informant and on the gun point snatching of Rs. 36,000/-. It is further alleged that three persons were arrested in connection with that and name of the petitioner transpired during course of investigation.
Submission of learned counsel for the petitioner is that except confessional statement of co-accused Mukesh Kumar, there is absolutely nothing against the petitioner. Heard learned A.P.P. also, who points out that petitioner is accused in one more case.
Having heard both sides and considering the facts and
Patna High Court Cr.Misc. No.47162 of 2018(4) dt.13-09-2018 2/2 circumstances, as stated above, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bond of Rs. 25,000/- (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M, Saharsa, in connection with Saharsa P.S. Case No. 328 of 2018, subject to the conditions as laid down under Section 438(2) Cr.P.C. and further condition is that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned.
