ANJANA MISHRA ORAL ORDER 29-07-2019 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is apprehending his arrest in connection with Chapra Town P.S. Case No.393 of 2018 for allegedly having committed the offence under Sections 341, 323, 324, 354, 34 of the Indian Penal Code.

Learned counsel for the petitioner submits that the entire allegation is false and mischievous and the allegation under Section 354 I.P.C. has been brought only to make the charge more stringent.

Considering the aforementioned facts and circumstances and the allegations made and that the petitioner is having clean antecedents, let the petitioner, above named, in the event of his arrest or surrender before

Case No.393 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
