The petitioner seeks bail in Sessions Trial No. 293 of 2019 arising out of Patna Junction (Patna Sahib) P.S. Case No. 319 of 2018, instituted for the offence under Section(s) 395 and 397 of the Indian Penal Code. Counsel for the petitioner submits that petitioner is not named in the written report. There is no recovery from possession of the petitioner. No Test Identification Parade has been held. Petitioner has been arrested merely on the basis of confessional statement of other co-accused. He further submits that co-accused Vivek Kumar has already been granted bail by coordinate Bench of this Court vide order dated 22.2.2019 passed in Cr. Misc. 10658 of 2019.

Considering the aforesaid facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.D.J.-VI, Patna, in connection with Sessions Trial No. 293 of 2019 arising out of Patna Junction (Patna Sahib) P.S. Case No. 319 of 2018, subject to the condition that both the bailors will be the close relatives of the petitioner.
