JUSTICE DINESH KUMAR SINGH ORAL ORDER 04/ 03-03-2015 Heard learned counsels for the petitioners and the State.

The petitioners are languishing in custody since 25.03.2014 in a case registered for the offences punishable under Section 392 of the Indian Penal Code.

Six lakhs rupees of the informant was robbed. Name of the petitioners sprang up during investigation.

Patna High Court Cr.Misc. No.40848 of 2014 (04) dt.03-03-2015 2/2 It is submitted by learned counsel for the petitioners that neither there is any recovery from the petitioners nor they have been put on TIP.

Statement has been made in para 3 of Cr.

Misc. No. 40848 of 2014 that the petitioner Mantu Mahto has no criminal antecedent whereas petitioner Sonu Kumar is accused in four other cases.

Considering the fact that petitioners have not been put on TIP, let the above named petitioners, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate/Judicial Magistrate, Ist Class, Hajipur, District - Vaishali in connection with Hajipur Town P.S. Case No. 594 of 2012.

Considering the criminal antecedent of petitioner Sonu Kumar, the learned court below will be at liberty to cancel the bail bonds of petitioner Sonu Kumar, if he substantially gets involved in some serious nature of the offence or defaults for two consecutive occasions.
