The sole petitioner, having clean antecedent, which fact has been stated in paragraph no. 3 of the petition, has approached this court for grant of bail in the event of his arrest or surrender in Chiraiya P.S. Case No. 63 of 2017, registered for the offence under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

By way of referring to the F.I.R., learned counsel for the petitioner submits that it is a peculiar case that though the Police Officer who is informant has stated that he had received information that huge quantity of country made liquor is being sold on the eve of Holi and a raid was shown to be conducted

Patna High Court Cr.Misc. No.37610 of 2017(3) dt.22-11-2017 2/2 in number of houses and from petitioner's house two liters of country made liquor was shown to be recovered. Considering the facts and circumstances, nature of accusation and clean antecedent of the petitioner , in the event of his arrest or surrender within a period of six weeks from today, let the petitioner Dharmendra Manjhi be enlarged on bail on furnishing bail bond of Rs. 10,000/- ( rupees ten thousand ) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate Sikrahana at Dhaka, District -East Champaran / concerned court in connection with Chiraiya P.S. Case No. 63 of 2017 subject to the conditions as contemplated under section 438 (2) of the Code of Criminal Procedure, 1973.
