====================================================== CORAM: HONOURABLE MR. JUSTICE BIRENDRA KUMAR ORAL ORDER 21-06-2021 Heard the parties in virtual Court.

Petitioner seeks bail in a case registered for the offences punishable under Sections 8,20(B),(ii)(B)of Narcotic Drugs and Psychotropic Substances Act, 1985.

From a plastic bag, 15 Kgs of Ganja was allegedly recovered and the recovery is alleged from possession of two persons i.e. the petitioner and co-accused-Akash Sah. Coaccused-Akash Sah has already been allowed bail by a Coordinate Bench of this Court considering submission of learned counsel for the petitioner that the mandates of law with regard to search and seizure was not followed in the case and the charges were already framed and the accused was ready to cooperate with the trial.

Considering the facts aforesaid, let the petitioner,

Patna High Court CR. MISC. No.1162 of 2021(6) dt.21-06-2021 2/2 above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Sathi Police Station Case No.49 of 2020 with following conditions:

(a) Both the bailors shall be resident of territorial jurisdiction of the learned Court-below.

(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.

(c) The petitioner shall not leave the country without permission of the trial Court.
