JUSTICE ANIL KUMAR SINHA ORAL ORDER 09-12-2022 Heard Mr. Om Prakash Upadhyay, learned counsel for the petitioner and Mr. Amitesh Kumar, learned Additional Public Prosecutor appearing for the State through video conferencing.
Petitioner seeks regular bail in connection with Alamnagar P.S. Case No. 67 of 2022 registered for the offences punishable under Sections 341, 323, 324, 307, 302, 120-B, 34 of the Indian Penal Code 1860 and Section 27 of the Arms Act. As per the First Information Report, the petitioner along with other accused persons started removing the bamboo fencing at informant's house, and when it was objected, the accused persons started firing and one of the accused Ved Prakash Munmun fired bullet upon the informant's husband, namely, Suman Kumar Singh, due to which, he died. Learned counsel for the petitioner submits that the petitioner has not committed any offence in the manner alleged and he has falsely been implicated in this case due to previous enmity between the parties. He next submits that the petitioner along with other accused are next door neighbours of the informant and the land dispute is pending between them bearing Title Suit No. 263 of 2011. The petitioner has got no criminal antecedent. He is in custody since 17.4.2022 and charge sheet has already been submitted.
Regards being had to the submission made by the parties and taking into consideration the fact that the petitioner did not fire upon the deceased, there is pending land dispute between the parties, the petitioner is in custody since 17.4.2022, charge sheet has already been submitted and there is no likelihood that the petitioner will abscond or tamper with the evidence, I am inclined to grant regular bail to the petitioner. Accordingly, let the petitioner, above named, be released on regular bail on furnishing bail bonds of Rs.20,000/- (Twenty thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. 1st, Udakishunganj,
