08-07-2015 Heard Sri Kaushalesh Chaudhary, learned counsel for the petitioner and learned A.C. to Govt. Pleader - 2. The present petition has been filed with a prayer to restore C.W.J.C. No. 7520 of 2004, which stood dismissed due to non-prosecution on 17-01-2013.
It has been indicated that in the writ petition, after demise of the then counsel for the petitioner, a fresh vakalatnama was filed through Sri Kaushalesh Chaudhary, learned counsel, but since his name was not appearing in the daily cause list, he could not mark the list and as such, the writ petition stood dismissed due to non-prosecution.
After hearing the parties and considering the ground set-forth in the petition, same is allowed.
Let C.W.J.C. No. 7520 of 2004 be restored to its
Patna High Court MJC No.2572 of 2013 (6) dt.08-07-2015 2/2 original file. Office is required to incorporate the name of Sri Kaushalesh Chaudhary, learned counsel for the petitioner in the daily cause list.
