Learned counsel for the respondents are present. It is submitted that the writ petition has become infructuous as the challenge was to the order of possession under Section 13(4) of the SARFAESI Act, 2002 but due to later development, the property itself has been auction sold on 19.12.2015 and thus the cause of action no more remains. It is further submitted that the recovery under the Public Demand Recovery Act was challenged in C.W.J.C. No. 317 of 2015, which has been withdrawn by learned counsel for the petitioner in the other case.
In view of the aforesaid, the writ petition stands disposed off.
