JUSTICE AMARESH KUMAR LAL ORAL ORDER 06-02-2015 Heard the learned counsel for the petitioners and learned A.P.P. for the State.
The petitioners are in custody since 30.06.2014 in a case registered for the offence punishable under Sections 147, 148, 149, 341, 323, 326, 307, 452 and 506 of the Indian Penal Code and 27 of the Arms Act.
The allegation is that the accused including the petitioners came to the roof of the informant, armed with firearm. Petitioner no. 2 shot fire at the husband of the informant which did not hit and thereafter, the petitioner no. 1 shot fire, which caused injury in the back side of the head of the informant. It is submitted that the injury of the informant has been found to be caused by hard and blunt substance. During investigation, the police has found it a concocted story. However,
Patna High Court Cr.Misc. No.39744 of 2014 (3) dt.06-02-2015 the police has submitted chargesheet against the petitioners. The petitioners have no criminal antecedent.
Considering the facts and circumstances of this case, the above-named petitioners are directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of SubDivisional Judicial Magistrate, Sikrahana, East Champaran at Motihari in connection with Ghorasahan P.S. Case No. 214 of 2014 with the following conditions:
1. One of the bailors will be the close relative of the petitioners.
2. The petitioners will not indulge in similar or in any other offence.
3. The petitioners will be well represented in the court.
4. In case of absence for two consecutive dates or in violation of the terms of the bail, their bail bonds will be liable to be cancelled by the court concerned.
