2. In this case, the petitioner is seeking regular bail in connection with NDPS Case No. 34A of 2022 arising out of Muffasil P.S. Case No. 425 of 2022, registered for the offences punishable under Sections 8, 20(B)(ii)(C) of the BNS.

3. Recovery is of 29.540 kg of Ganja from the vehicle of the petitioner.

4. The learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in the present case. The petitioner is a person of clean antecedent. He was not arrested at the spot and nothing has been recovered from his possession. As a matter of fact, the driver of the petitioner was arrested with ganja loaded in the vehicle. The driver misused the vehicle of the petitioner and the petitioner was not aware that his

5. On the other hand, the learned APP for the State has opposed the prayer for bail.

Considering the above-mentioned facts and circumstances especially the clean antecedent of the petitioner, let the petitioner, above-named be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-I-cum-Special Judge, NDPS Act, Begusarai in connection with NDPS Case No. 34A of 2022 arising out of Muffasil P.S. Case No. 425 of 2022, subject to the condition that the petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.

7. Before accepting the bail bonds, the learned Court below shall verify the criminal antecedent of the petitioner and if it is found that he is involved in any other case except the present case, his bail bonds shall not be accepted.
