Heard Mr. Umesh Kumar Mishra, learned counsel for the petitioner, Mr. Rajiv Kumar, learned counsel for the informant and Mr. Ram Priya Sharan Singh, learned counsel for the State. This is an application seeking quashing of the F.I.R of Siwan Town P.S. Case No. 214 of 2015 dated 05.06.2015 instituted for the
offence under Sections 341, 323, 389, 511, 504, 506 and 34 of the Indian Penal Code.
On 21.03.2018, a bench of this Court had called for a report from the court below about the stage of the case, which has since been received and kept at flag 'X'. The report indicates that in this case cognizance has been taken on the basis of protest petition after accepting the final form and the case is pending for appearance of accused persons. In that view of the matter, there would be no necessity of pursuing with the present petition as it has become infructuous. This petition stands dismissed as having become infructuous.
