2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 103 (1), 238 of the BNS and Section 27 of the Arms Act.

3. The case of the prosecution, in brief, is that Ashraf and Farooque were murdered by unknown miscreants.

4. Learned counsel for the petitioner submits that the FIR was initially lodged against unknown miscreants. During the course of investigation one Rahul Kumar was apprehended and in his confessional statement, he has named his associates, including the petitioner. It is further submitted that except the confessional statement of Rahul Kumar, there is no material whatsoever against the petitioner. It is also submitted by the

No.46632 of 2025(4) dt.04-09-2025 2/2 learned counsel for the petitioner that the said Rahul Kumar himself has already been extended the privilege of bail by a coordinate Bench of this Court vide order dated 06.08.2025 passed in Cr. Misc. No. 36481 of 2025 and the case of this petitioner stands on better footing. Moreover, the petitioner is languishing in judicial custody since 11.04.2025.

5. Learned APP appearing on behalf of the State has vehemently opposed the prayer for bail but has fairly conceded that the name of the petitioner has surfaced only on the basis of the confessional statement of Rahul Kumar, who has already been granted bail by a Bench of this Court.

6. Considering the aforesaid facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Jalalpur P.S. Case No. 39 of 2025 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Saran.
