1. Heard learned counsel for the petitioner and learned APP for the State.
2. No one appears on behalf of the opposite party no.2.
3. The petitioner seeks bail in anticipation of his arrest in a case registered for the offences punishable under Sections 341, 323, 354B, 307, 498A, 406, 504, 506, 34 of the Indian Penal Code and Sections 3 and 4 of the D. P. Act.
4. The learned counsel for the petitioner submits that the case was referred for mediation by an order dated 30.07.2025. It is next submitted that from perusal of the
Patna High Court CR. MISC. No.47569 of 2025(3) dt.30-10-2025 2/3 report of the learned Mediator dated 15.09.2025, it would manifest that the same records that the dispute in between the parties has been resolved through the process of mediation and the terms of settlement mutually agreed upon them is being attached. It is further submitted that opposite party no.2 is living happily with the petitioner at her matrimonial home. It is further submitted that this perhaps explains why no one appears on behalf of the opposite party no.2.
5. Learned A.P.P. also does not opposes the anticipatory bail application in view of the report of the learned Mediator.
6. Considering the submissions made by the learned counsel for the petitioner, the petitioner, abovenamed, in the event of his arrest or surrender before the learned Court below within a period of six weeks, is directed to be released on anticipatory bail on his furnishing bail-bonds in the sum of Rs. 5,000/- (Rupees Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Sasaram in connection with Mahila P. S. Case
Patna High Court CR. MISC. No.47569 of 2025(3) dt.30-10-2025 3/3 No.29 of 2023, subject to the conditions laid down under Section 438(2) of the Cr.P.C.
7. The application stands allowed.
