JUSTICE RAKESH KUMAR ORAL ORDER 06-07-2017 After some argument, Sri Ratnakar Jha, learned counsel for the petitioners in presence of learned Additional Public Prosecutor seeks permission to withdraw the anticipatory bail petition so far petitioner no. 1 is concerned. The prayer is allowed.

Heard Sri Ratnakar Jha, learned counsel for the petitioners and learned Additional Public Prosecutor . It was alleged that petitioner no. 2 Subaida Khatoon wife of one Md. Chand Ali had also participated in the occurrence, however the petitioner no. 2 has approached this court for grant of privilege of anticipatory bail in connection with Arer P.S. Case No. 69 of 2015 corresponding to GR No. 25 of 2015 registered

Patna High Court Cr.Misc. No.16508 of 2017 (2) dt.06-07-2017 2/2 for the offence under section 341, 323 , 307/ 34 , 504 of the Indian Penal Code.

I have perused the F.I.R. and the materials available on record. Considering the fact that petitioner no. 2 Subaida Khatoon is a lady and there is no specific accusation against her, in the event of arrest or surrender within a period of six weeks from today, let the petitioner no. 2 Subaida Khatoon be enlarged on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of Sri Ajay Kumar II, learned Judicial Magistrate -1st Class, Benipatti, Madhubani / concerned court in connection with Arer P.S. Case No. 69 of 2015 corresponding to GR No. 25 of 2015 subject to the conditions as contemplated under section 438(2) of the Code of Criminal Procedure, 1973.
