The petitioners apprehend their arrest in Sonepur P.S. Case No. 217/2018, registered for the offences punishable under Sections 304(B), 498A and 34of the Indian Penal Code and section 3, 4 of Dowry Prohibition Act.
Informant alleged that his daughter was married to Anant Singh petitioner no. 2 in the year 2017. After marriage her in-laws including petitioner no. 2 started demand of dowry and subjected her to mental and physical torture. On 20.03.2018, her husband (petitioner no.2) and other family members brutally assaulted and killed her on account of non-fulfillment of demand of dowry.
It has been submitted that Geeta Devi petitioner no. 1 is mother-in-law of the deceased and Anant Singh petitioner no. 2 is husband of the deceased. Petitioners have falsely been implicated in the case. From post-mortem it appears that there is no external injury on the person of the deceased. The cause of death mentioned in post-mortem report is gangrene.
Considering the facts aforesaid, the petitioners abovenamed, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate I, Saran, Chapra in connection with Sonepur P.S. Case No. 217/2018, subject to the conditions:
(1.) Bailors should be local having sufficient immovable property within the jurisdiction of the court concerned.
(2.) Petitioners shall co-operate in the trial and shall be present on each and every date fixed by the court and their absence on two consecutive dates without proper and
reasonable reason will be sufficient to cancel their bail bonds.
(3.) If the petitioners tamper with the evidence or the witnesses of the case, in that case, prosecution will be at liberty to move for cancellation of bail of the petitioners.
