Petitioner seeks bail in a case registered for the offences punishable under Sections 498(A), 341, 323, 302, 201/34 of the Indian Penal Code and Section 3/4 of the Dowry Prohibition Act.
The informant is not an eyewitness of the actual occurrence. The daughter of the informant was married with this petitioner. Allegation is that due to non-fulfillment of dowry demand, the petitioner thrashed her three years old daughter Nishi Kumari, which resulted in head injury and death. Learned counsel for the petitioner submits that the witnesses of the occurrence have stated that both the spouse were quarreling and during scuffle the victim girl got injured
Patna High Court CR. MISC. No.44181 of 2019(3) dt.26-09-2019 2/2 with stone lying thereat and thereafter she died. Considering the facts of the case aforesaid as well as completion of investigation and no allegation of tampering with the evidence, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned court below where the case is pending in connection with Ariari Police Station Case No.16 of 2019, subject to condition that both the bailors shall be resident of the territorial jurisdiction of the learned court below and the petitioner shall fully co-operate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
