====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 05-07-2022 Heard learned counsel for the petitioners and learned A.P.P. for the State.

The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 302 and 201 of the Indian Penal Code.

Learned counsel for the petitioners submits that petitioners are Fua and Fufa of the deceased and are persons with clean antecedent and the informant alleges that on account of matrimonial dispute, she alongwith her children was staying with her parents for the last 5-6 years, it is next alleged that her father-in-law had taken away her minor daughter on the pretext of cutting paddy crop, further it is next alleged that informant after sometimes came to know that her daughter has been killed.

Learned counsel for the petitioners submits that from bare

Patna High Court CR. MISC. No.56025 of 2021(2) dt.05-07-2022 2/2 perusal of the allegation as alleged in the FIR, it would manifest that general and omnibus allegation has been levelled against the petitioners. It is next submitted that absolutely no motive has been assigned for the petitioners to commit the occurrence. It is also submitted that the petitioners have been implicated as the informant who is staying separately from her husband for the last 5-6 years has taken this as an opportunity to implicate the innocent petitioners. It is next submitted that Ful Kunwari Devi has been granted anticipatory bail by order dated 05.07.2022 in Cr. Misc. No. 54407 of 2021. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioners.

Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of her arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.5,000/- (Rupees Five Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Karai Parsurai P.S. Case No. 141 of 2020, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
