The appellants seek pre-arrest bail in connection with Maner P.S. Case No. 77 of 2021 registered under Sections 147, 148, 149, 341, 323, 379, 354, 504, 509 of the Indian Penal Code and Section 3(i) (r) (s) and 3(ii) (v) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act. Submission of learned counsel for the appellants is that appellants are innocent and have falsely been implicated in
Patna High Court CR. APP (SJ) No. 3965 of 2021(2) dt.21-10-2021 2/2 the present case. Further submission is that there is no specific allegation against the appellants. Appellants have no criminal antecedent.
Having heard both sides and in the facts and circumstances of the case, let the above named appellants be released on bail, in the event of arrest or surrender, on furnishing personal bond to the satisfaction of the Additional Sessions Judge-III-cum-Special Judge, SC/ST Act, Patna in connection with Maner P.S. Case No. 77 of 2021, subject to the conditions as laid down under section 438(2) of Cr. P.C. Accordingly, the appeal is allowed and the impugned order dated 25.08.2021 is set aside.
