====================================================== CORAM: HONOURABLE MR. JUSTICE SUDHIR SINGH ORAL ORDER 30-06-2021 Heard learned counsel for the petitioner and the State through virtual mode.

The petitioner seeks bail in a case for the offence registered under Sections 8/20(b)(ii)(c)/25/29 of the Narcotic and Psychotropic Substances Act.

Earlier prayer for bail of the petitioner was rejected vide Annexure-1 to the present application taking into account that 587.700 kg. Ganja was recovered from the truck. It has been submitted on behalf of the petitioner that the petitioner is in custody since 14-08-2018. As per the report submitted by the trial court, charge has been framed in the case on 27-05-2019 and since then, not a single witness has been

Patna High Court CR. MISC. No.4001 of 2021(3) dt.30-06-2021 2/2 examined in this case for last two years. Hence there is no chance of the trial being concluded in near future. It is further pointed out by the counsel for the petitioner that prior to the date of occurrence, the truck, in question was sold by the petitioner to one Paras Kumar. It is further pointed out that there is no compliance of Sections 42 & 50 of NDPS Act.

On behalf of the State, it is submitted that the petitioner is named in the Complaint Case/F.I.R. Considering the aforesaid facts and circumstances of the case and also the lockdown, let the petitioner, above named, be released on bail on his personal bond to the satisfaction of learned Additional Sessions Judge-XVIIth, Patna in connection with Economic Offences P.S. Case No. 13 of 2016 (Special Case No. 72(A) of 2016).

Once the normalcy is restored, the petitioner shall furnish bail bonds of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each within a period of eight weeks to the satisfaction of the court concerned in connection with the aforesaid case.
