JUSTICE SUDHIR SINGH ORAL ORDER 11-10-2018 The earlier anticipatory bail application of the petitioners was dismissed as withdrawn vide Annexures-1 and 2 to the present application. No order has been passed on merit. Heard learned counsel for the petitioners and learned APP for the State.

The petitioners are apprehending their arrest in a case registered under Sections 419, 420, 447, 448, 465, 467, 468, 471, 379, 506, 120B of the Indian Penal Code. The prosecution case, in short, is that the accused persons including the petitioners misappropriated the funds of cooperative and taken away the documents of co-operative.

Patna High Court Cr.Misc. No.54403 of 2018(4) dt.11-10-2018 2/3 It has been submitted on behalf of the petitioners that the petitioner have got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioners. The petitioners have falsely been implicated in the present case. The petitioners No.1 and 2 are aged 28 years and 24 years respectively. Both the petitioners are ladies. So far petitioner No.3 is concerned, he is aged 26 years. Nothing specific has been alleged against the petitioners in the F.I.R. The main allegation is against co-accused Prem Prakash Verma, who is alleged to have misappropriated the funds of co-operative and taken away the documents of co-operative. Other co-accused have been granted anticipatory bail vide Annexure-4 series to the present application.

On behalf of the State, it is submitted that the petitioners are named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioners, above named, in the event of arrest/surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st class, Patna in connection with Digha P.S. case
