The petitioners seek pre-arrest bail in connection with Mashrakh P.S. Case No. 320 of 2016 registered for the offences punishable under Sections 420, 467, 468 and 471 read with 34 of the Indian Penal Code.
It is stated by the learned counsel for the petitioners that a false and fabricated complaint has been instituted by the complainant against the petitioners and two others. It is

No.21627 of 2017 (2) dt.06-07-2017 2 / 2 submitted that the said complaint was referred to the police for investigation, pursuant to which, the first information report was instituted. It is further contended that there is presumption in law regarding genuineness of a registered document. It is also contended that the petitioner has got clean antecedent and has got roots in the society.
Learned counsel for the State has opposed the prayer for grant of pre-arrest bail to the petitioners. Having regard to the submissions made above, considering the nature of allegation, the petitioners are directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-8th, Saran at Chapra in connection with Mashrakh P.S. Case No. 320 of 2016 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure, in the event of arrest or surrender within a period of six weeks from today.
