JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 06-07-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Karjain P.S. Case No. 03 of 2017 registered under Section 366/34 of the Indian Penal Code.

The accusation is that, on 28.12.2016, in the evening, grand-daughter of informant had gone to attend the call of nature but she did not return. On search, no trace was found. The informant raised suspicion about kidnapping of her grand-daughter by Mukesh Kumar with the help of Raghunandan Mahta and Laxmi Devi with intention to perform the marriage. Learned counsel for the petitioner submits that it would appear from the F.I.R. that there was love affair in between

No.15275 of 2017 (2) dt.06-07-2017 the grand-daughter of the informant and co-accused Mukesh Kumar and she left the village with Mukesh Kumar according to her own sweet will but with ulterior motive, petitioner, who is the maternal uncle of Mukesh Kumar, has falsely been implicated in this case.

Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the J.M. Ist Class, Birpur (Supaul) in connection with Karjain P.S. Case No. 03 of 2017, subject to the condition as laid down under Section 438(2) of the Cr.P.C. (Rajendra Kumar Mishra, J) Bhardwaj/- U T
