This application has been filed for cancellation of anticipatory bail granted to the opposite party no.2 by a Coordinate Bench of this Court vide order dated 02.08.2023 passed in Cr. Misc. No.23879 of 2022 in connection with Buniyadganj P.S. Case No.255 of 2021 registered for the offence under Sections 420, 468 and 471 of the Indian Penal Code.

The petitioner prays for cancellation of bail of the opposite party no. 2 on the ground that the opposite party

Patna High Court CR. MISC. No.57304 of 2024(3) dt.23-07-2026 2/2 no.2 has violated the condition imposed by the Coordinate Bench of this Court while confirming the provisional bail. 4.

Considering the aforesaid, this application is disposed of with a direction to the petitioner to file an application before the Court below for cancellation of bail bonds of the opposite party no.2. If such an application is filed, the Court below shall consider and dispose of the same in accordance with law within fifteen days of its filing. While deciding the application, the Court below shall verify the submission regarding non-payment of the balance amount by the opposite party no.2 to the petitioner.
