2. The petitioner apprehends arrest in connection with Ramnagar P.S. Case No. 349 of 2024 dated 06.08.2024, instituted for the offence punishable under Sections 303(2), 3(5) of the Bharatiya Nagarik Suraksha Sanhita, 2023.

3. The prosecution case, in short, is that the informant parked his motorcycle bearing Registration No. BR22AP0249 near Shiv Temple, Ramnagar, and went to talk with his friend. In the meantime, two persons came there and took away his motorcycle.

4. Learned counsel for the petitioner submits that the petitioner is innocent and he has been falsely implicated in this case. It is further submitted that the FIR has been lodged against unknown persons. Petitioner has been made accused only on the

Patna High Court CR. MISC. No.45567 of 2025(3) dt.17-10-2025 2/2 basis confessional statement of co-accused Anuranjan Sharma @ Rahul Sharma. It is next submitted that nothing has been recovered from conscious possession of the petitioner. The stolen motorcycle was recovered from the house of Dilshan Ansari. It is further submitted that the CCTV footage has been shown to the local villagers, who identified the driver of stolen motorcycle as Anuranjan Sharma @ Rahul Sharma. Lastly, it has been submitted that petitioner has no criminal antecedents.

5. Learned A.P.P. has opposed the prayer for bail of the petitioner.

Having considered the facts and circumstances of the case and submissions of learned counsel for the parties, in the event of arrest / surrender of the petitioner within a period of six weeks from today, in connection with Ramnagar P.S. Case No. 349 of 2024, he shall be released on anticipatory bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Bagaha, West Champaran subject to condition as laid down under Section 482(2) of the B.N.S.S.
