The petitioner apprehends his arrest in Thakurganj P.S. Case No. 12/2017, registered for the offences punishable under Sections 420, 467, 468, 471 and 120B of the Indian Penal Code.

The gist of the allegation is that the petitioner was appointed on the post of teacher on the basis of forged certificates and he is working as teacher from 02.07.2007. Learned counsel for the petitioner submits that the petitioner had no knowledge that certificates are not genuine. He received mark-sheet and certificates from the school, but from perusal of the F.I.R. itself, it appears that the certificates of the petitioner were sent to different institutions for verification and it

Patna High Court Cr.Misc. No.20162 of 2017 (2) dt.06-07-2017 2/2 was found that the certificates of the petitioner were forged. Considering the facts aforesaid and the fact that petitioner has got appointment to the post of teacher on the basis of forged certificates, I am not inclined to enlarge the petitioner above-named on anticipatory bail. Accordingly, the same is rejected.

If the petitioner surrenders in the court below within four weeks from the date of receipt/production of a copy of this order and pray for regular bail, learned court below shall consider the prayer for regular bail of the petitioner on its own merit without being prejudiced by this order and dispose of the same preferably on the same day.
