JUSTICE SAMARENDRA PRATAP SINGH ORAL ORDER 06-07-2017 Heard learned counsel for the petitioners and the State as well as learned counsel for the informant.

The petitioners apprehend their arrest in a case under Sections 498A and 30B of the Indian Penal Code. It is alleged that the accused persons tortured and killed Rinki Kumari due to non-fulfillment of demand of dowry. It is further alleged that the accused persons murdered the victim in Chapra and carried the dead body to Kolkata.

Learned counsel for the petitioner submits that admittedly the victim was found dead in Kolkata and a U.D. Case bearing Uttar Para U.D. Case No.117 of 2017 has been lodged. In fact, the victim used to stay with her husband at Kolkata and the petitioners used to live in at their native at Chapra.

Learned counsel for the informant submits that the victim

Patna High Court Cr.Misc. No.18086 of 2017 (3) dt.06-07-2017 has been killed within a year of her marriage. Having regard to the facts that the dead body of the victim was found in Kolkata where her husband used to work, the petitioners, namely, Luxmeena Devi @ Laxmi Devi, Sushil Kumar Sah, Sunil Kumar @ Sunil Kumar Sah, Nand Kishroe Sah, Sapana Devi @ Sapana Sah and Saneha Kumari @ Saneha Sonam are directed to be released on anticipatory bail, in the event of their arrest/surrender, on furnishing bail bonds of Rs.5,000/- each with two sureties of the like amount each to the satisfaction of the A.C.J.M. XII, Chapra in Bheldi P.S. Case No.17 of 2017 subject to the conditions that petitioner No.4 Nand Kishore Sah will not absent himself in the court below for two consecutive dates till two witnesses are examined in the trial, failing which his bail bond would be cancelled.
