JUSTICE SHIVAJI PANDEY ORAL ORDER 06-07-2017 Heard learned counsel for the petitioners and learned counsel for the State.

In this case, the petitioners are seeking anticipatory bail in connection with Janata Bazar P.S. Case No.96 of 2015, registered for the offence punishable under Sections 365, 420, 406, 506/34 of the Indian Penal Code.

As per the F.I.R., allegation has been made by the informant that accused persons have taken his father and got the land executed measuring about an area of 1.5 bigha. In the statement, the informant has stated that his father is suffering from paralysis and he was not intending to execute the land, but the persons got the land executed by alluring him.

No.19453 of 2017 (3) dt.06-07-2017 2/2 The informant is own brother-in-law of the petitioner no.1 and own brother of petitioner no.2 and the land has been executed by father of petitioner no.2 and father-in-law of petitioner no.1. It appears that it is a family dispute of civil nature.

Looking to the aforesaid facts and circumstances of the case, let the above-named petitioners, be released on anticipatory bail in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) each with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, Saran at Chapra, in connection with Janata Bazar P.S. Case No.96 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
