The petitioner seeks bail in connection with Nawanagar P.S. Case No. 230 of 2022, dated 13.07.2022, instituted for the offences under Sections 20(b), (ii), (c) and 22(b) of the Narcotic Drugs and Psychotropic Substances Act, 1985.

From the house of the petitioner, 1.20 kilograms of Ganja is said to have been recovered.

No.46725 of 2022(2) dt.28-11-2022 2/3 The learned counsel for the petitioner has submitted that the quantity of Ganja has wrongly been weighed only to prevent the petitioner from taking advantage of small quantity which, perhaps, has been recovered from his house for which also, the petitioner has an explanation.

The two seizure-list witnesses have not supported the prosecution version.

It is the further submission of the petitioner that he is a social activist and his outspokenness against the local police has resulted in this false implication. The petitioner is in custody since 14.07.2022. Regard being had to the aforesaid facts, especially the period of custody and the recovery of Ganja, which is a little more than the small quantity, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned

While saying so, this Court has also taken note of the fact that the petitioner has earlier not been made accused in a case of this nature.
